1. Just Car Insurance Website Security and Privacy Statement
1.1 This website is operated by Just Car Insurance Agency Pty Ltd (ABN 41 050 238 563) of Level 9 / 616 St. Kilda Road, Melbourne, Victoria, 3004 (“Just Car”) and it includes all web pages under or forming part of the domain name “www.canvas2kickass.com” (“Promotional Website”). The Promotional Website’s domain name is owned by George Patterson Y&R Pty Ltd (ABN 67 117 645 708). Just Car is additionally the operator of certain social media forums (“Social Media Forum”) hosted by third party providers. Just Car clearly identifies the Social Media Forums it operates.
1.2 This Security and Privacy Statement explains our policy for handling personal information which you may provide to us as you access and interact with the Promotional Website and/or a Just Car operated Social Media Forum. 'Personal information' means information which identifies you as an individual or from which your identity can reasonably be ascertained. Just Car encourages you to review this Security and Privacy Statement periodically as it may be updated from time to time.
1.3 This Statement should be read in conjunction with the Website and Social Media Terms of Use, which govern your use of the information, graphics and materials on the Promotional Website and the Social Media Forums. By using the Promotional Website and/or a Social Media Forum you agreed to be bound by the terms of this Privacy and Security Statement.
1.4 In addition to the provisions of this Security and Privacy Statement, there may also be additional privacy provisions that apply to your participation in a Social Media Forum or as a result of your membership (or your application for membership) of a social media site. Importantly, should you decide to register for and, at your option, participate in the canvass2kissass promotion (“Promotion”) you will additionally be bound by the CANVAS2KISSASS PROMOTION TERMS & CONDITIONS (“Promotion Terms and Conditions”) which can be found on this Promotional Website. The Promotion Terms and Conditions include information about how a registered entrant’s personal information is handled. With respect to registered entrants, if any term within this Privacy and Security Statement should conflict with the Promotion Terms and Conditions, the later will prevail to the extent of the conflict. Should you register for a supporting promotion (to the main Promotion) your personal information will be collected and handled as set out in the specific terms of entry to that supporting promotion and otherwise in accordance with this Privacy and Security Statement. If any term within this Privacy and Security Statement conflict with the specific terms of a supporting promotion, the later will prevail to the extent of the conflict.
2. Your Security and Privacy
2.1 Just Car understands and appreciates that you, as visitor or user of the Promotional Website and/or a Social Media Forum, are concerned about the security, privacy and confidentiality of information we may gain about you online. Just Car is committed to respecting your privacy and, at all times, complies with its obligations under the Privacy Act 1988 (Cth).
2.2 Just Car values the personal information you give us and will take all reasonable precautions to prevent unauthorised access to that information. Unless we have your consent, Just Car Insurance will not give your personal information to any other organisation for their marketing purposes. Just Car Insurance has taken measures to respect your privacy and the security of any personal information you may provide to us while visiting the Promotional Website and/or a Social Media Forum.
2.3 Notwithstanding the above, you agree and freely acknowledge that when you submit comments, recordings, images or other personal content, for public display on the Promotional Website and/or a Social Media Forum, that content may be available for anyone in the world to read and/or view. See term 4 for further information about the public display of your content.
3. Sending electronic messages to Just Car
3.1 Unless otherwise stated, when you send Just Car an email, the content of your email and your email address is retained by us for only as long as it takes to respond to your inquiry or provide you with what you’ve requested, unless you provide us with your permission to retain that information for longer or where we believe there is a legal reason to retain the information for a longer period.
3.2 Unless otherwise stated, when you post a public comment or upload other data to the Promotional Website and/or a Social Media Forum, that information may be displayed by Just Car publically in accordance with term 4 below. Your information may also be retained by Just Car where we believe there is a legal reason to retain it for a longer period.
4. Information collected and how we use it
4.1 General information
4.1.1 The information we will collect about you will depend on how you use the Promotional Website and/or a Social Media Forum.
4.1.2 If you visit the Promotional Website and/or Social Media Forum to read, browse or download information, our computer system may record information such as the date and time of your visit, the pages accessed and any information downloaded. This information may be used for statistical, reporting, website/Promotion administration and maintenance purposes only.
4.1.3 The Promotional Website and/or Social Media Forums may offer interactive facilities including tools, games and other online features. If you use any interactive facilities, we may, but generally do not, capture any personal information which you may enter when using these tools.
4.2 Personal information submitted to the Promotional Website or to a Just Car operated Social Media Forum
4.2.1 When a user of the Promotional Website (whether a registered entrant of the main Promotion or supporting promotion or not) and/or a Social Media Forum (“General User”) submits any personal information via the Promotional Website and/or Social Media Forum, whether in the form of comments, recordings, images or otherwise (“Content”), the General User consents to that personal information being collected by Just Car and used and disclosed for any purpose permitted by this Privacy and Security Statement, and otherwise as permitted by the Privacy Act 1988 (Cth). In the case of personal information which is provided to Just Car for public display (this includes any ‘tweet’ you send to Just Car on Twitter, which we may “re-tweet” to other Twitter users), this may include displaying that information to other users of the Promotional Website and/or a Social Media Forum or otherwise displaying the Content for any purpose in any media (including, but not limited to, company brochures and other marketing and/or advertising material). See also term 8 of what other uses or disclosures Just Car may make of a General User’s personal information.
4.2.2 Just Car may collect personal information belonging to a General User, such as their name, email address or social media site alias, in order to provide them with the interaction or outcome they have requested. This may require Just Car to disclose a General User’s personal information to one or more third parties, including but not limited to agents or external service providers.
4.2.3 If you are visiting and submitting your personal information to a Social Media Forum, you should also first read and understand the separate privacy policy or policies that apply to your use of the social media site that hosts our Social Media Forum. Just Car is not responsible to you for the information handling practices of any third party social media site.
4.2.4 The privacy rights and complaints handling process explained in term 5.1 apply to General Users.
4.3 Registering and entering the Promotion or a supporting promotion: collection and use of information
4.3.1 If you decide to register to enter the Promotion or a supporting promotion, you will need to agree to the Promotion Terms and Conditions or the specific terms of entry for a supporting promotion (as relevant). They are each found on this Promotional Website and you should read them. When it comes to your privacy, registering for the Promotion will require you register for an online account on the Promotional Website, which means you will need to provide Just Car with your full name, email address, contact telephone number, date of birth, postcode and a user-selected password. Optionally, you may also wish to provide us with the expiry date of your current car insurance policy, if it is not already held with Just Car.
4.3.2 By registering to enter the main Promotion, you will consent to receive Promotion-related emails and you will also be provided with the opportunity to opt-in to receive separate future marketing communications from the Promoter and Alpine Electronics of Australia Pty Ltd of 161-165 Princess Highway, Hallam, Victoria, 3803 ("Alpine"). The Promoter's marketing communications may contain content from the Promoter or an affiliated third party, including Alpine.
4.3.3 If you decide to participate in a supporting promotion that is conducted by Just Car, whether on the Promotional Website or on a Social Media Forum, Just Car will collect the necessary personal information it requires from you to allow you to participate in that promotion, and should you win a prize, to contact you to arrange for its provision. Just Car may also collect other information from you (for example, we may ask if you’d like to receive marketing communications from us in future), however it is your choice whether you would like provide this other information to us.
4.3.4 Just Car will collect personal information belonging to a promotion entrant (whether an entrant into the main Promotion or a supporting promotion) or to someone who expresses an interest in entering a promotion (for example, someone who provides us their personal details at a car show) in order to conduct the promotion (including to assist them to enter the promotion), and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities.
4.3.5 In accordance with term 4 Just Car may provide the personal information collected from registered entrants for the main Promotion (apart from information relating to their car insurance) to Alpine. If consented to by a registered entrant for the main Promotion, Just Car and/or Alpine may, for an indefinite period use the personal information each respectively holds for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the registered entrant ("Permitted Uses") if so permitted by law. In the case of Just Car, these Permitted Uses may relate to Just Car's products or services or Just Car may communicate information or offers from an affiliated third party, including Alpine. A registered entrant for the main Promotion can telephone Just Car on 13 13 26 or send an email to contactus@justcarinsurance.com.au to opt-out from future use of personal information collected during the main Promotion. They should quote "canvas2kickass promotion" when opting-out. In the case of Alpine, the Permitted Uses will relate to its own products or services, and will be otherwise in accordance with its own online privacy policy, which can be accessed at: www.alpine.com.au. Registered entrants for the main Promotion can opt-out of future use of their personal information by contacting Alpine on the address shown in term 5.2 below.
4.3.6 In the case of someone providing their personal information to Just Car to allow it to assist them to enter the main Promotion or a supporting promotion (whether they ultimately choose to do so or not), Just Car may collect the person’s name, email address, telephone number, name of current car insurer, expiry date of that insurance, and consent to receive continued marketing information from Just Car. If you no longer wish to receive marketing information from Just Car, you can tell them by unsubscribing from an electronic communication they send you or call them on 13 13 26 or send an email to contactus@justcarinsurance.com.au
5 Your privacy rights and the complaints handling processes available
5.1 If Just Car has collected your personal information, then you have a right to access, update or correct that personal information, with some limitations as permitted by Australian law. You should direct any request to access, update or correct information us, by sending an email to: contactus@justcarinsurance.com.au. We will promptly review your email and contact you with a reply or ask you to provide further information, if we need it. If you aren’t satisfied with the decision we provide you, we will provide you with information about the appeal rights you have. If you are a Just Car policyholder, you will have access to Just Car’s dispute resolution department.
5.2 If you are a registered entrant for the main Promotion and you consented to receive marketing updates from Alpine, then you have a right to access, update or correct the personal information Alpine holds about you, with some limitations as permitted by Australian law. 6. Third party websites (including third party social media sites)
6.1 The Promotional Website and/or Social Media Forums may contain links to websites or social media sites which are owned or operated by third parties independent of Just Car ("Third Party Websites"). Third Party Websites should contain their own privacy statements and those third parties are responsible for informing you about their security and privacy practices.
7. Cookies
7.1 The Promotional Website uses "cookies" as a fundamental part of its interaction with your internet browser. Cookies enable Just Car to provide you with a superior, customer-oriented service. A "cookie" is a small text file placed on your computer by our web server. A cookie can later be retrieved by the Just Car website servers. Cookies are frequently used on websites and you can choose if and how a cookie will be accepted by configuring your preferences and options in your browser. Cookies do not alter the operation of your computer in any way.
7.2 If you wish to make full use of the Promotional Website, it is recommended that you accept cookies. Cookies may also be used to record non-personalised information such as the date, time or duration of your visit, or the pages accessed, for website administration, statistical and maintenance purposes. Any such information will be aggregated and not attributed to individual users.
7.3 The social media sites which host our Social Media Forums may also use cookies. You should refer to their respective terms or use and privacy policies for details.
8. Additional use and disclosure of your personal information
8.1 Other than the uses and disclosures of personal information described in the terms above, Just Car may also use or disclose personal information or information generated by cookies which you have provided to us when:
a) you have authorised us to do so;
b) we have given you notification of the intended use or disclosure and you have not objected to that use or disclosure;
c) when fraud or unlawful activity is suspected by Just Car and the information is disclosed to relevant persons or authorities;
d) in accordance with this Privacy and Security Statement;
e) we believe that the use or disclosure is reasonably necessary to assist a law enforcement agency or an agency responsible for national security in the performance of their functions; or
f) Just Car is authorised, required or permitted by law to disclose the information.
9. The personal information of other people
9.1 You agree to obtain the prior consent of any other person whose personal information (whether in the form of words, images, recordings or otherwise) you submit to Just Car on the Promotional Website and/or a Social Media Forum. Just Car will collect this information from you in good faith and take reasonable precautions to ensure it is handled in accordance with the Privacy Act 1988 (Cth). If you are not sure whether the other person would agree with you providing their personal information to Just Car, please exercise caution and do not provide it to us.
10. Acceptance and changes to this Privacy and Security Statement
10.1 You acknowledge and accept that your use of the Promotional Website and/or a Social Media Forum indicates your acceptance of the Website and Social Media Terms of Use and the Security and Privacy Statement. Just Car may at any time vary the Security and Privacy Statement by publishing the varied Security and Privacy Statement on the Promotional Website. Just Car is under no obligation to specifically notify you of any variation to the Security and Privacy Statement. You accept that by your use of the Promotional Website and/or a Social Media Forum after any variation, Just Car has provided you with sufficient notice of the variation and you are taken to have accepted the new Security and Privacy Statement.
